Sean “Diddy” Combs has been denied bail for the second time. Prostitution case In New York City, a federal judge ruled Wednesday that Combs must remain in custody without bail pending an appeal from his legal team, according to the Associated Press.
U.S. District Judge Andrew Carter Jr. said in a bail hearing Wednesday afternoon that prosecutors showed “clear and convincing evidence” that “there is no condition or set of conditions that would ensure the safety of the community or prevent Combs from potentially bribing witnesses if he were released.”
On Tuesday, federal judge Robin Tarnowski agreed with prosecutors and denied bail to the hip-hop mogul who was due to appear in federal court after being charged with sex trafficking, racketeering conspiracy and transportation for prostitution. Combs pleaded not guilty at the same hearing in lower Manhattan court.
According to online records from the Federal Bureau of Prisons, Combs is being held in a detention facility across the East River from Manhattan in Brooklyn, New York.
Combs’ attorney, Mark Agnifilo, told CBS News correspondent Jerryka Duncan before Wednesday’s hearing that some parts of the detention center where Combs is being held are “very difficult.”
“It is impossible to prepare a trial where he is,” Agniphilo said.
In a letter to Tarnowski, prosecutors argued that Combs was a flight risk and “poses an ongoing threat to the safety of the community.”
Agniphilo denied the charges against his client and vowed to fight for his release.
“We will fight this case with everything we have, just like he did, and ultimately he will be found not guilty,” Agnifilo told reporters outside the Daniel Patrick Moynihan U.S. Courthouse after Tuesday’s hearing.
Prosecutors accused Combs of using his business empire as a criminal enterprise to cover up allegations that he abused women at events he called “Freak Offs.”
“The ‘Freak Offs’ sometimes lasted for days, involved multiple commercial sex workers and often involved a variety of drugs, including ketamine, ecstasy and GHB, which Combs distributed to his victims in an effort to ensure their compliance and acquiescence,” Damien Williams, the U.S. attorney for the Southern District of New York, told reporters Tuesday.
